PERSONAL DATA PROTECTION DISCLOSURE STATEMENT

Our company, Esde Araç Kiralama ve Dış Ticaret Ltd. Şti., acts as the “Data Controller” within the scope of the Law No. 6698 on the Protection of Personal Data, published in the Official Gazette dated April 7, 2016, and the relevant legislation.

1. Definition

As the Data Controller, our company shall record, store, and update your personal data in accordance with the Law on the Protection of Personal Data and the relevant legislation, within the scope stated below.
Your personal data may only be disclosed, transferred, classified, and processed within the limits stipulated by the Law on the Protection of Personal Data and relevant legislation, and only in cases permitted by law.

2. Your Personal Data

Your personal data processed by our company may include, but are not limited to, the following:

  • Your full identity information such as name, surname, Turkish ID number, passport number, place and date of birth, mother’s and father’s name, gender, marital status, and similar identity details,

  • Your contact information such as address, phone number, e-mail address, workplace details, and similar communication data,

  • Information obtained during the execution of the vehicle rental agreement,

  • Financial information such as payment and invoicing details, IBAN number, credit card information, bank account details, credit score-related data and attachments,

  • CCTV camera recordings obtained during your visits to our branches and offices,

  • Vehicle license plate information recorded when our parking areas are used,

  • Documents requested as annexes to the vehicle rental agreement, such as activity certificates, professional qualification documents, personal data contained in professional association membership cards, signature circulars, and signature declarations,

  • Personal data contained in e-mails sent to our corporate e-mail addresses and in letters sent to our legal address,

  • Your Social Security Institution data,

  • Audio recordings obtained during call center communications,

  • If you apply for a job with our company, your résumé and personal data obtained from references,

  • If you are employed by our company, all personal data contained in your personnel file, including health records requested due to job requirements and similar personal data.

3. Purposes of Processing Personal Data

Our company processes personal data in order to provide vehicle rental services, vehicle sales and service activities, and all related products and services within its field of operation.
Personal data may be collected and processed through automatic or non-automatic methods, verbally, in writing, or electronically, via offices, branches, call centers, websites, mobile applications, and similar channels, for the establishment and performance of contracts related to products and services, and for purposes directly or indirectly related thereto.
Personal data required by legislation and mandatory public authority requirements are stored in accordance with the law.

Your personal data specified in Article 2 may be processed for the following purposes, in compliance with applicable laws:

  • Conducting analyses to improve services,

  • Providing information regarding your reservations,

  • Issuing invoices,

  • Verifying your identity,

  • Responding to your questions or complaints regarding our services,

  • Ensuring compliance with internal policies and rules of group companies,

  • Measuring and improving customer satisfaction,

  • Offering promotions, discounts, personalized advertisements/campaigns, and other benefits, and contacting you for promotional and informational purposes via e-mail,

  • Performing collection transactions such as mail-order and transfer instructions,

  • Providing vehicle protection services,

  • Sending you daily/monthly vehicle rental offers,

  • Improving service quality by receiving technological services from expert third-party companies,

  • Providing necessary information to official authorities in line with their requests and audits,

  • Fulfilling legal obligations such as sharing vehicle rental information with public authorities including law enforcement agencies,

  • Providing and promoting products and services jointly with business partners and other third-party individuals or entities, and conducting financial reconciliations,

  • Determining your location and sharing it with authorized institutions in case roadside assistance is requested,

  • Storing data required to be retained under applicable legislation, backing up data to prevent loss, and taking necessary technical and administrative measures to ensure data security,

  • Legal follow-up and similar purposes, without limitation to the above.

4. Transfer of Personal Data

Our company may transfer personal data, for the purposes stated above and in accordance with legal regulations, domestically and internationally, including but not limited to the following parties:

  • Group companies affiliated with our company,

  • Courier and cargo companies when document delivery is required,

  • Lawyers, auditors, consultants, and other service providers,

  • Financial institutions,

  • Banks,

  • GSM operators for sending important notifications,

  • Your authorized representatives or attorneys,

  • Courts, enforcement offices, tax offices, and other public institutions and authorities,

  • Service providers, subcontractors, and cooperating organizations involved in the execution of company activities.

5. Methods of Collecting Personal Data

Our company may collect, process, and transfer personal data verbally, in writing, or electronically through the Head Office, branches, internet, call center, mobile applications, SMS, interactive voice response systems, and other face-to-face channels, based on your consent and/or Articles 5 and 6 of the Law on the Protection of Personal Data.

6. Your Rights Under the Law on the Protection of Personal Data (Effective as of 07.10.2016)

Pursuant to the Law, you may submit your requests and questions in writing to Esde Araç Kiralama ve Dış Tic. Ltd. Şti. General Directorate, located at Yavuz Selim Mah. Gülibrişim Sok. No:16/A Arnavutköy / İstanbul, and you have the right to:

a) Learn whether your personal data is being processed,
b) Request information if your data has been processed,
c) Learn the purpose of processing and whether it is used in accordance with such purpose,
ç) Know the third parties to whom your data is transferred domestically or abroad,
d) Request correction of incomplete or inaccurate data,
e) Request deletion or destruction of personal data within the framework of Article 7 of the Law,
f) Request notification of the actions taken pursuant to (d) and (e) to third parties to whom data has been transferred,
g) Object to any outcome to your detriment arising solely from automated processing,
ğ) Request compensation for damages incurred due to unlawful processing of personal data.

Your applications will be concluded free of charge as soon as possible and no later than thirty (30) days, depending on the nature of the request. However, if additional costs arise, our company reserves the right to charge a fee in accordance with the tariff determined by the Personal Data Protection Board.
